Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is in custody in connection with Maharajganj P.S. Case No. 189 of 2017 for the offence under sections 302, 120B,34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The informant has lodged information on 17.10.2017. It is appears that informant has received information as to the killing of her son from unknown. Learned counsel for the petitioner submits that petitioner is innocent. He has been falsely implicated in this

Patna High Court Cr.Misc. No.22087 of 2018(4) dt.17-05-2018 2/2 case. There is no eye-witness to the occurrence to have seen this petitioner involved in the commission of crime. Considering the delay in lodging FIR and the fact that the petitioner has no criminal antecedent, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-V, Siwan, in connection with Maharajganj P.S. Case No. 189 of 2017 on the condition that bailors should be family members of the petitioner.
