The petitioner is in custody since 06.12.2017 in connection with Banka P.S. Case No. 418 of 2017 for the offence registered under Sections 341, 147, 323, 324, 325, 307 and 427 of the Indian Penal Code and Sections 3 & 4 of the Explosive Substance Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that while the informant was returning home on his motorcycle and his elder brother was also accompanying him on another motorcycle, the petitioner along with other unknown persons attacked the informant and on alarm being raised by his brother all the accused persons ran away. No.19804 of 2018 (3) dt.26-04-2018 further submitted that the petitioner has falsely been implicated in connection with the present case and the informant himself is a veteran criminal, who is dealing with the business of Balu Ghat. It is further submitted that similarly situated co-accused persons has been extended the privilege of regular bail vide order dated 10.04.2018 passed in Cr. Misc. No. 14973 of 2018. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 418 of 2017.
