Petitioner is an accused in a case registered for offence under sections 366A and 120B of the IPC as well as under section 8 of the POCSO Act.
Learned counsel for the petitioner submits that other than suspicion there is nothing on the record to connect the petitioner with the offence.
Allegation made in the FIR is that the petitioner and co-accused Dhannu Thathera made last call and sent message on the mobile phone of informant's daughter before her missing.
In view of the gravity of allegation as also the fact that the victim has not been recovered till date, I am not inclined to
Patna High Court Cr.Misc. No.18244 of 2018 (3) dt.16-05-2018 2/2 grant bail to the petitioner for the present. The prayer for bail of the petitioner is rejected.
