The present application has been filed for modification of the order dated 20-05-2022 passed in Cr. Misc. No. 24945 of 2022 by which the petitioners were granted anticipatory bail in connection with Mashrakh P.S. Case No. 49 of 2022 pending in the court of learned Judicial Magistrate-Ist Class, Saran at Chapra.

It is submitted on behalf of the petitioners that they were suffering from Spondilitis and admitted in Mars Hospital, Patna for treatment. It is further submitted that they were

Patna High Court CR. MISC. No.54181 of 2022(2) dt.12-10-2022 2/2 advised to take complete rest and that is why, they could not surrender within the stipulated time. It is further prayed on behalf of the counsel for the petitioners that further time may be extended so that the petitioners could surrender in the court below.

Considering the submissions made on behalf of the learned counsel for the petitioners and the grounds mentioned in the modification application, the order dated 20-05-2022 passed in Cr. Misc. No. 24945 of 2022 is modified to the extent that the period of surrender of the petitioners in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order.

The rest of the conditions shall remain the same as mentioned in the order dated 20-05-2022 passed in Cr. Misc. No. 24945 of 2022.

Accordingly, this modification application stands disposed of.
