The petitioners apprehend their arrest in connection with Mahanar P.S. Case No. 113 of 2019, registered under Sections 366 and 365/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Vaishali at Hajipur. The accusation is that in the evening of 04.04.2019, Chunchun Kumar (petitioner no.2) and Kundan Kumar (petitioner no.3) gave information to informant, Nitish Kumr, to the effect that his sister, Arti Kumari was talking with Amarjeet at Abdulla Chawk then informant along with Chunchun Kumar

Patna High Court CR. MISC. No.53771 of 2019(2) dt.27-08-2019 2/2 (petitioner no.2) and Kundan Kumar (petitioner no.3) went at Abdulla Chawk and when they returned from there then six persons named in the FIR along with petitioners and Amarjeet came at his village. Thereafter, aforesaid six persons along with co-villagers came at the house of informant and forcibly took away his sister, Arti Kumari causing assault to him and his mother and forcibly performed the marriage with Amarjeet. Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
