JUSTICE ARUN KUMAR ORAL ORDER 25-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sadar PS Case No. 421 of 2017 registered under Sections 143, 144, 158, 290, 414, 272, 273 of the IPC and Section 25(1-b)s, 25-1A, 25(1)AA, 251AAA, 26, 26(II), 35 and 27 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act.
The allegation in brief is that birthday party of daughter of Surendra Rai was being celebrated in his house, liquor was served and it is alleged that country made pistol with live cartridge was recovered from the possession of the petitioner and arms were also recovered from other co-accused.
Learned Counsel for the petitioner submits that this petitioner was apprehended with one country made pistol with a live cartridge, he is in custody since 245.8.2017 and other co-accused Chandan Kumar and Surendra Yadav have been admitted to bail by a coordinate Bench of this Court.
Having considered the said facts and circumstances, the petitioner, namely, Pawan Kumar Srivastava is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten
Patna High Court Cr.Misc. No.4435 of 2018 (2) dt.25-01-2018 thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge -cum- Special Judge (Excise) Muzaffarpur in connection with Sadar PS Case No. 421 of 2017.
