2. The petitioner seeks bail in connection with Motihari Town P.S. Case No. 599 of 2024 instituted for the offences punishable under Section 309(4) of the BNS and Sections 25(1-b)a, 27 and 35 of the Arms Act.
3. As per the prosecution case, on the alleged date of occurrence, the petitioner and other accused persons have allegedly snatched Rs. 1,15,000/- from the informant on the point of pistol and knife.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that the

No.58261 of 2025(2) dt.27-08-2025 2/3 petitioner has been made accused in this case only on the basis of confessional statement of co-accused Pratik Singh @ Priyanshu Kumar @ Priyanshu Singh. He further submits that the petitioner was neither arrested on the spot nor any incriminating articles has been recovered from the conscious possession of the petitioner. He next submits that there is no Test Identification Parade conducted till dated against the petitioner. Petitioner is in custody since 05.05.2025.
5. Learned APP for the State opposes the prayer for bail.
6. From perusal of the FIR and impugned order of the learned 20th Additional Sessions Judge, East Champaran, Motihari dated 11.07.2025, it appears that petitioner is not named in the FIR. The name of the petitioner has been surfaced in this case only on the basis of confessional statement of coaccused Pratik Singh @ Priyanshu Kumar @ Priyanshu Singh, who has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 11976 of 2025 vide order dated 12.05.2025. Investigation has already been completed and no Test Identification Parade has been conducted till date as stated by learned counsel for the petitioner, so considering all these aspects of the matter, I am inclined to grant bail to the petitioner.

7. Accordingly, the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Motihari Town P.S.
