JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 The petitioner seeks bail in connection with Kankarbagh P.S. Case No. 122 of 2017, dated 24.02.2017, instituted for the offence punishable under Section 379 of the Indian Penal Code.
The vehicle of the informant was stolen. The petitioner has been remanded in the present case from another case in which he was in custody.
It has been submitted on behalf of the petitioner that nothing has been recovered from his possession nor has he been put on Test Identification Parade. It has also been

No.26827 of 2018 (3) dt.18-05-2018 2/2 submitted that because of the local police not being charitable towards him, he is being made accused in all such cases of similar nature and is being continuously remanded in one case or the other. If there was any semblance of truth in the allegation made against the petitioner, he ought to have been put on Test Identification Parade.
The petitioner is in custody since 29.03.2017. Regard being had to the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, In-Charge, Kankarbagh Police Station, Patna in connection with Kankarbagh P.S. Case No. 122 of 2017.
