The petitioner seeks pre-arrest bail in connection with Kankarbagh P.R. Case No. 81 of 2019, pending in the Court of the Special Judge, Excise, Patna, for the offences alleged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that petitioner, Golu Kumar, and Arbind Kumar were apprehended with Tata Magic AVE Ex, bearing registration no. BR02-GA-2261 and on search of said vehicle, 280 liters of country made liquor said to be recovered while petitioner and Arbind Kumar were apprehended at that time, but, petitioner succeeded to flee away from there. Patna High Court CR. MISC. No.55331 of 2019(2) dt.02-09-2019 2/2 opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case and the nature of allegation, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for prearrest bail is rejected. The petitioner is directed to surrender before the Court below and seek regular bail, which will be considered on its own merit and without being prejudiced of this order.
