JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 03-02-2016 Heard counsel for the petitioner and the State. The application seeks restoration of CWJC No. 15595 of 2012 which stood dismissed for non compliance of the order dated 28.08.2012.
By the said order, the petitioner was directed to furnish requisites within 07 days for service of notice on respondent nos. 5 & 6. It is stated that the petitioner was diligent to comply with the order inasmuch as requisites were filed on 05.09.2012. The delay of only one day occurred for which explanation has been offered.
Patna High Court MJC No.4414 of 2014 (2) dt.03-02-2016 2/2 Considering the facts and circumstances of the case, the application is allowed. Time granted under order dated 28.08.2012 stands extended to 05.09.2012.
