Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 325, 307, 504 of the Indian Penal Code and 17 of the Criminal Law Amendment Act.
Some unknown Naxals allegedly assaulted to the informant for non-payment of levy. On the basis of information of the spy, name of the petitioner has surfaced. There is no direct evidence against the petitioner. Petitioner is in custody since 09.12.2017. Petitioner has got criminal antecedent.
Considering the aforesaid material against the petitioner and fate of the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like
Patna High Court Cr.Misc. No.12953 of 2018 (3) dt.23-04-2018 amount each to the satisfaction of learned Court below where the case is pending in connection with Uphara Police Station Case No.39 of 2006, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
