The petitioner seeks regular bail in connection with Hisua P.S. Case No. 46 of 2018, registered for the offence punishable under Sections 413 and 114 of the Indian Penal Code.
The allegation is regarding the police having raided the house of the co-accused person, namely, Chandan Kumar and recovered two motorcycles. Upon disclosure of Chandan Kumar, raid was conducted in the house of the petitioner and some stolen motorcycles were recovered.
The learned counsel for the petitioner submits that the petitioner is a mechanic and therefore, the motorcycles
Patna High Court Cr.Misc. No.25893 of 2018(4) dt.28-05-2018 2/2 recovered from his shop / house belongs to the customers. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 17.02.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Hisua P.S.
