Mr. Smt. Asha Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 02-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Hajipur Sadar P.S.Case No. 519 of 2017 registered under Sections 302, 341, 342 and 120B of the Indian Penal Code and 27 of the Arms Act.

Accusation is that while the informant was on morning walk along with her husband, motorcycle borne criminals on two bykes arrived there and Mantu Paswan shot at him causing injury to him and thereafter Dilip Sahni shot in his abdomen causing his death and also taken into captivity of her son and other persons.

Submission is that petitioner is not named in the FIR however the specific accusation of killing the deceased is

No.31071 of 2018(4) dt.02-08-2018 2/2 against Mantu Paswan and Dilip Sahni and only material in the case diary against the petitioner is confession given in the supervision note and one criminal antecedent against him and not any other material is available and this petitioner has been in custody since 16.01.2018.

Having considered the aforesaid facts and circumstances and the nature of evidence against the petitioner, he, namely, Subhash Gupta @ Chandan @ Chandan Ji, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 519 of 2017.
