The petitioner seeks bail in Morkahi P.S. Case No. 41 of 2021, registered for the offence under Section 25(1-B)a, 26 of the Arms Act and Section 30(a) of Bihar Prohibition and Excise Act.
As per the F.I.R., one country-made Masket without any cartridge and approx. 10 liters of illicit foreign liquor have been recovered from the petitioner's house and one Bolero vehicle, which was parked in the campus.
It is submitted on behalf of petitioner that no incriminating article has been recovered from the possession of the petitioner. Recovery has been made from the house, which is in joint possession of the family and the alleged Bolero vehicle
Patna High Court CR. MISC. No.66998 of 2021(3) dt.14-02-2022 2/2 does not belong to this petitioner. Petitioner has got clean antecedent and he is in custody since 22.09.2021. Investigation is complete.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Khagaria in connection with Morkahi P.S.
