====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------------- 15-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Madhuani Town P.S. Case No.446 of 2014 (G.R. No.3426 of 2014) registered under Sections 406, 420, 504 and 506 of the Indian Penal Code.

The prosecution case is that the informant, Manoj Kumar Sah, who is motorcycle mechanic, used to run the motorcycle repairing shop. In between 11.01.2009 till March, 2013, the informant took spare parts from the Auto Spare Shop of the petitioner worth Rs.13,14,300/- but on calculation the amount,

Patna High Court Cr.Misc. No.43500 of 2015 (2) dt.15-10-2015 2/2 which was paid to the petitioner, was found Rs.15,79,875/- In spite of demand by the informant, the excess amount was not paid to him by the petitioner.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the payment was made by the informant with respect to the spare parts as taken by him from the Auto Spare Shop of the petitioner but with an ulterior motive, the informant has lodged this false case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case No.466 of 2014(G.R. No.3426 of 2014), subject to the conditions laid down under Section 438(2) Cr.P.C.
