The petitioner apprehends his arrest in Sour Bazar P.S. case No. 91 of 2018 registered under Section 341, 323, 379, 34 of the IPC.

The informant alleged that three miscreants, having armed with different weapons, intercepted him and snatched his mobile and motor cycle and assaulted him.

The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. The petitioner is named in the FIR only because petitioner is well acquainted with the informant from before and on account of enmity name of the petitioner has been dragged in the case but it appears that it is a case of road robbery in which the informant was intercepted and robbed by the petitioner and

Patna High Court CR. MISC. No.52690 of 2019(2) dt.26-08-2019 2/2 two other criminals, who were armed with fire arms, and the accused persons snatched mobile and motor cycle of the informant after assaulting him. The informant claimed to identify the petitioner by his voice.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
