JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the parties.

Petitioners are in custody since 23.6.2014 and 29.8.2014 respectively in a case under section 395 of the IPC. Learned counsel for the petitioners submit that their name figured in confessional statement of co-accused and nothing has been recovered from them. Furthermore, they are on bail in earlier cases lodged against them which is the cause of their implication in the instant case.

In the facts and circumstances of the case, all the four

No.47434 of 2014 (2) dt.03-03-2015 petitioners as mentioned above are directed to be released on bail on furnishing bail bond of Rs.5,000/-each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in Dighalbank(Korhobari) Police station Case No. 65 of 2014.

The petitioners will not be physically absent for two consecutive dates at a stretch till three witnesses are examined in the trial. One of the bailors of the petitioners would be a Class III Government servant.
