JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-06-2016 The certified copy of the First Information Report of Jogbani (Bathnaha) Police Station Case No. 69 of 2015 has been filed on behalf of the petitioner, let the same be kept on record.

Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Jogbani (Bathnaha) Police Station Case No. 69 of 2015, disclosing offences under Sections 302/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Learned Counsel for the petitioner has very fairly submitted that the application for grant of

Patna High Court Cr.Misc. No.10385 of 2016 (3) dt.22-06-2016 2/2 anticipatory bail filed on behalf of the co-accused Ahilya Devi has been rejected by this Court. He has not been able to distinguish the case of the present petitioner, who is father-in-law of the deceased, with that of Ahilya Devi, who is the mother-in-law of the deceased.

Considering the submissions, as above, I am not inclined to grant the petitioner privilege of anticipatory bail. This application for anticipatory bail, is hereby, rejected.

The petitioner, Golok Nath Jha @ Golak Nath Jha @ Golake Nath Jha, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
