JUSTICE SUDHIR SINGH ORAL ORDER 27-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 504 and 307/34 of the Indian Penal Code.
Allegation against the petitioners is that they demanded ransom of Rs.50,000/- from the informant. Further, on the instruction of accused Binod Singh, co-accused Ram Bilash Singh fell down the electric wire from the poll, as a result of which son of one Barun Singh received electric shock and got injured. It is submitted on behalf of the petitioners that they have got no criminal antecedent. They have been falsely implicated in the present case. No specific injury has been attributed against the petitioners. From perusal of the injury report (Annexure-2) it would appear that injury is simple in nature. Hence, no offence under Section 307 of the Indian Penal Code is attracted against the petitioners.
On behalf of the State, it is submitted that petitioners are

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri S. K. Mishra, learned Judicial Magistrate, 1st Class, Nawada, in connection with Kawakol (Rupau) P.S. Case no. 57 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
