The petitioner seeks regular bail in connection with Special Case No. 6413 of 2017 arising out of Hathidah P.S. Case No. 65 of 2017 instituted for the offences under Section 30(a) of the Bihar Prohibition Excise Act, 2016.
The allegation is regarding recovery of 110 litres of illicit liquor from two sacks which are said to have been thrown away by the petitioner and one co-accused and upon chase the said accused persons were apprehended by the Police.
The learned counsel for the petitioner submits that no recovery has been effected from the person of the petitioner, barring one case the petitioner has a clean antecedent and he is in custody 25.09.2017.
Patna High Court Cr.Misc. No.63378 of 2017 (2) dt.17-01-2018 2/2 Considering the nature of accusation and the period of custody already undergone, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 6413 of 2017 arising out of Hatidah P.S. Case No. 65 of 2017.
