The petitioner apprehends his arrest in a case under Sections 304(B)/34 of the Indian Penal Code.

The father of the deceased alleged that his daughter was married to Neeraj Yadav on 25.01.2014 but she was killed on 18.04.2015. Neeraj called Santosh, the nephew of the informant, that his wife committed suicide. The informant alleged that Neeraj and his family members, father and brother killed his daughter. It is submitted that the petitioner is the younger brother of Neeraj Yadav. He solemnized inter-caste marriage in the year 2006 and is living separately from his brother and other family members. No specific allegation is made against the petitioner. The petitioner is a teacher.

Considering the facts aforesaid and the fact that no

No.43839 of 2015 (4) dt.16-12-2015 2/2 specific allegation is made against the petitioner and the petitioner was separated only on account of the fact that he solemnized intercaste marriage, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Pirbahore P.S. Case No. 76/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
