The petitioners apprehend their arrest in Nokha P.S. Case No.143 of 2017 registered under Section 363 of the Indian Penal Code.

The informant, uncle of the victim lodged the case against unknown for missing of his niece.

The learned counsel for the petitioners submits that the victim appeared and made her statement under Section 164 of the Cr.P.C.. Victim disclosed that while she was watching dance, these petitioners forcibly kidnapped her and took her to a lonely

Patna High Court Cr.Misc. No.57342 of 2017 (2) dt.03-01-2018 place. Jitendra @ Jaisurya also came there and thereafter she went along with Jitendra @ Jaisurya to Pune. She further disclosed that she solemnized marriage with Jitendra. It is further submitted that petitioner has falsely been implicated in the case. In fact, the victim voluntarily left her house and solemnized marriage with Jitendra @ Jaisurya. Jitendra @ Jaisurya has already been granted regular bail vide order passed in B.P. No.1025 of 2017.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge IX-cum-ACJM, Rohtas at Sasaram in connection with Nokha P.S. Case No.143 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
