The petitioner who was an aspirant for being appointed as a constable seeks bail in connection with Gardanibag P.S. Case No. 77 of 2018 dated 06.03.2018 instituted for the offences under Sections 417 and 420 of the Indian Penal Code.

The thumb impression of the petitioner, taken at the time of physical examination was found to be different from what has been obtained during the written examination. On the basis of the aforesaid difference in the thumb impression on two occasions, the prosecution has jumped to the conclusion that the petitioner had attempted to succeed in the examination by cheating. Patna High Court Cr.Misc. No.26417 of 2018(3) dt.18-05-2018 2/2 submitted that no such attempt was made by the petitioner to become successful in the examination by cheating. Similarly situated other accused persons have also been granted bail by different Benches of this Court. The petitioner is in custody since 23.02.2018. Considering the aforesaid facts the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Gardanibagh P.S. Case No. 77 of 2018.
