The petitioner is in custody since 13.01.2014 in a case registered for the offence punishable under Sections 25(1-B)A, 26 and 35 of the Arms Act and Section 307 of the Indian Penal Code. It is submitted that nothing has been recovered from the possession of the petitioner. His name has been disclosed by the co-accused. It is also submitted that for the same occurrence Triveniganj P.S. Case No. 23 of 2003 has also been lodged in which he has been granted bail.

The learned counsel for the State submits that the petitioner has a long list of criminal antecedent. Considering the facts and circumstances of this case, the

No.5148 of 2015 (2) dt.06-02-2015 above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case No. 24 of 2003 after framing of charge with the following conditions:

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
