The petitioner seeks regular bail in connection with Barauli PS case no. 58 of 2018 instituted for the offences punishable under Sections 379, 420 of Indian Penal Code. The allegation in the present case is regarding the petitioner having exchanged the A.T.M. card of the informant and had withdrawn Rs. 1,37,000/-.

The learned counsel for the petitioner submits that only a sum of Rs. 40,000/- has been transferred in the account of cousin brother of the petitioner namely Dharmendra Giri. It is further submitted that as far as the petitioner is concerned, he has no complicity in the matter. It is further submitted that the

It is next submitted that the petitioner was having a clean antecedent up to the filing of the present case. The petitioner is said to be languishing in custody since 01.03.2018. It is lastly submitted that the petitioner is ready to deposit Rs. 40,000/- for the purposes of grant of bail.

Having regard to the facts and circumstances of the case, the petitioner is directed to deposit a sum of Rs. 40,000/- in the Nazarat of the court and upon showing the receipt of the said deposit to the concerned court, the concerned court shall grant regular bail to the petitioner on such conditions as it may deem fit and proper to be imposed.

The petition is disposed of.
