The petitioner has filed the instant application for grant of regular bail in connection with Begusarai Town P.S. Case No. 750 of 2021 registered under Sections 395, 397 and added Section 412 of the Indian Penal Code.

Prosecution case in short is that 5 to 6 unknown accused persons having lashed with fire arm committed dacoity of approx 70kg silver and 500grams gold with cash. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case merely on suspicion. It is further submitted that the petitioner is not named in FIR rather the name of the petitioner came into light in this case

Patna High Court CR. MISC. No.57308 of 2022(2) dt.02-02-2023 2/2 during investigation on the basis of confessional statement of co-accused Gopal Chaudhary with whom the petitioner has no concern. Neither the petitioner has been put on T.I.P. nor any incriminating article has been recovered either from the house or the conscious possession of the petitioner rather the looted article has been recovered from the co-accused Sabita Chaudhary. The petitioner is languishing in judicial custody since 22.02.2022.

The application for bail vehemently is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Begusarai Town P.S. Case No. 750 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Begusarai.
