2. The petitioner seeks bail in connection with Kadwa P.S. Case No. 40 of 2024 instituted for the offences under Sections 406, 409, 420 of the Indian Penal Code.

3. Allegation against the accused persons including the petitioner is of misappropriating 93.12 MT paddy worth Rs. 19,22,928/-

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that from perusal of the FIR it appears that no specific allegation has been levelled against the petitioner as the same is levelled against PACS, President.

No.60986 of 2024(7) dt.05-02-2025 2/3 Learned counsel further submitted that petitioner is PACS, Secretary and does not have any hand in the purchase/sale of the paddy crop. Learned counsel further submitted that there is no cogent material against the petitioner regarding his involvement in the alleged occurrence. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.05.2024 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that as per paragraph nos. 5 and 6 of the case diary, several witnesses have supported the case of the prosecution. Learned APP further referring to paragraph no. 15 of the counter-affidavit submitted that the petitioner is involved in the embezzlement of paddy crop to the tune of Rs. 19,22,298/- and therefore, he may not be released on bail.

6. Considering the aforesaid facts and circumstances of the case, nature and gravity of offence, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.

8. Learned Trial Court is directed to expedite the trial.

9. The District Magistrate, Katihar and the

Patna High Court CR. MISC. No.60986 of 2024(7) dt.05-02-2025 3/3 Superintendent of Police, Katihar are also directed to produce the prosecution witnesses before the learned court below as and when required.
