This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by the learned Additional District and Sessions Judge-1st-cumSpecial Judge, Jehanabad, in Sessions Trial No.164/017/213/017 arising out of Kurtha P.S.Case No. 72 of 2017 registered under Sections 147, 148, 149, 341, 323, 307, 504, 427, 436 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(1) (x)(r) (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
It appears that having similar accusation coaccused Abhay Singh has already been allowed bail by a
Patna High Court CR. APP (SJ) No.3584 of 2017 (3) dt.02-02-2018 Coordinate Bench of this Court in Cr.Appeal (S.J.) No.2326 of 2017.
Hence, let the appellant, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the appellant shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the appellant. Accordingly, the appeal stands allowed and the impugned order is set aside.
