JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-08-2015 The petitioner has prayed for quashing order contained in Memo no. 107 dated 31.3.2013, whereby the SDO, Hajipur has cancelled his licence.
Learned counsel submits that the petitioner was granted Licence no.93 of 2007 for running shop under PDS within Raghopur block in district Vaishali. He has assailed the order on the ground that no show cause was received by him. Further, the allegations leveled against him are incorrect, as many of the consumers have filed affidavits denying having made any allegations.
On the other hand, counsel for the State submits that the show cause was served upon the petitioner.
Without going into the counter versions of the parties, the writ petition is disposed of with liberty to the petitioner to take resort to the remedy of appeal.
Patna High Court CWJC No.7038 of 2013 (5) dt.13-08-2015 In case, an application for condoning the delay is filed, the appellate authority should consider the same sympathetically, as the petitioner was pursuing the remedy before this Court.
It is expected that the appeal so filed would be disposed of expeditiously.
