2. The petitioner is in custody in connection with Rupau P.S. Case No. 75 of 2025 for the offence punishable under sections 137(2) and 87 of the B.N.S., lodged on 25.04.2025 by the informant, Sunita Devi.

3. As per the prosecution story, the informant alleged that her daughter went missing and later it came to notice that she used to call to a particular mobile number which belonged to this petitioner. This led to the F.I.R.

4. Subsequently, the victim girl appeared, made statement before the Court that she left for Mumbai on her own, met with the petitioner, got married and further refused to undergo medical examination.

5. Learned counsel for the petitioner submits that he is a young boy, the only fault is that he had a relationship with the informant's daughter, he is in custody since 03.06.2025 and has clean antecedent.

6. Learned APP opposes the prayer for bail.

Taking into account the submissions of the parties as also the fact that the petitioner is a young boy having no criminal antecedent, is in custody since 03.06.2025, the victim girl had not supported the prosecution story, in that background, this Court is inclined to extend him the privilege of bail.

8. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Nawada, in connection with Rupau P.S. Case No. 75 of 2025 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

Patna High Court CR. MISC. No.55340 of 2025(2) dt.12-08-2025 3/3 (iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) vinayak/- U T
