JUSTICE ARUN KUMAR ORAL ORDER 25-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.7.2017, seeks bail in Garkha PS Case No. 287 of 2017 registered under Sections 147, 148, 149, 341, 302, 120B of the IPC and Section 27 of the Arms Act. The allegation in brief is that the petitioner along with others ambushed informant's relative and indiscriminately fired at him causing his death at the Petrol Pump.
Learned Counsel for the petitioner submits that the date of occurrence is 13.7.2017 and the petitioner a day prior to that had surrendered in the Court of ACJM Chapra in connection with another case and has enclosed the order of surrender in the supplementary affidavit, moreover the fact was also verified by the police during investigation as referred in para 29 and 74 of the case diary.
Having considered the said facts and circumstances, the petitioner, namely, Satyajit Singh @ Satyajit Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM II, Chapra in connection with Garkha PS Case No. 287 of 2017.
