JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Hilsa PS Case No. 685 of 2017 registered under Sections 379, 414, 34 of the IPC, Section 4/40 BMMC Rules and Section 8 of the Mining and Mineral Act.

It is submitted that the petitioner was found driving a tractor laden with sand and the petitioner is admittedly the driver and not the owner of the tractor and is in custody since 15.11.2017. Having considered the said facts and circumstances, the petitioner, namely, Rajesh Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Hilsa in connection with Hilsa PS Case No. 685 of 2017.
