JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 20-12-2016 Heard the counsel for the petitioner and the State. A prayer for grant of anticipatory bail is made in Pirbahore P.S. Case No. 48 of 2015 registered under section 384 IPC. It is alleged that using different cell phones threatening was held out and ransom was demanded. The informant suspected the hands of the petitioner in the alleged crime. It is submitted that there is no criminal antecedents of the petitioner who is a licensee of the drug and operate a pharmacy retail shop at Govindmitra Road, Patna.
Counsel for the State, on going through the case diary, contended that the wife of the informant suspected from the voice of the caller as the petitioner.
Considering the fact that the petitioner has no criminal
Patna High Court Cr.Misc. No.10805 of 2016 (5) dt.20-12-2016 2/2 antecedents and the incriminating materials are not such which would require detention of the petitioner, the court directs his release on anticipatory bail.
Accordingly, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri A. K. Ram, Judicial Magistrate, 1st Class, Patna in Pirbahore P.S. Case No. 48 of 2015 on condition that one of the bailors of the petitioner shall be his own/close family member. The petitioner shall appear before Station House Officer, Pirbahore or the Officer who is second-incommand of the police station every fortnight and file his written attendance till the submission of the charge-sheet. In case of default in doing so the Station House Officer shall inform the court concerned whereafter the learned court below shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
