Shamimul Hoda, learned Counsel, appearing for the petitioner in C.W.J.C. No. 12340 of 2015, and Mr. Rajiv Roy, learned Government Pleader No.5, appearing for the State respondents.

Mr. Syed Asghar Najmi, learned Counsel, appearing for the respondent Waqf Board, has placed on record a copy of the application, filed before the Bihar State Waqf Tribunal, made under Section 54(3) of the Waqf Amendment Act, 2013, for removal of encroachment from Waqf property, by giving the names of two alleged encroachers, namely, Syed Safdar Hussain Jafri and Syed Nazeer Hussain. The application aforementioned has been registered as Eviction Application No. 01 of 2016. In view of the above, it becomes clear that it is, now, for the Bihar State Waqf Tribunal to do the needful in accordance with law.

These writ petitions, which have been, made under Article 226 of the Constitution of India, in the nature of Public Interest Litigation, are disposed of with direction to the Bihar State Waqf Tribunal to expeditiously deal with the matter and dispose of the Eviction Application No. 01 of 2016 within,

4/4 preferably, a period of four months from the date of receipt of a copy of this order by the Tribunal.
