The petitioners seek bail in a case registered for offences under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 189 litres of foreign liquor was recovered from the car parked beside the road where four persons were standing but when they tried to escape seeing the raiding police party two persons were apprehended on chase and two persons managed to escape and the apprehended persons disclosed the name of the

Patna High Court Cr.Misc. No.56253 of 2017(2) dt.23-11-2017 2/2 petitioners on the basis of which the petitioners have been implicated in this case.

It is contended that the petitioners have no connection with the seized car or the alleged recovered illicit foreign liquor since no incriminating article has been recovered from the possession of the petitioners. It is urged that the petitioners have remained in custody since 17.09.2017, i.e., for about more than two months. It is claimed that the petitioners are having clean antecedent.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna in connection with Beur P.S. Case No. 226 of 2017 (Special Case No. 6174 of 2017) with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
