Petitioner is in jail custody since 16.11.2015 in a case registered under sections 364A and 120B of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, one co-accused Shabaz was arrested and made his confessional statement disclosing involvement of the petitioner in the present crime. Furthermore, it would appear from the impugned order that the petitioner happens to be brother of FIR named accused Ratnesh and except the aforesaid confessional statement, there is nothing against him.
Moreover, the concerned I.O did not take any pain to put the petitioner on TI Parade.
Accordingly, petitioner is directed to be released on bail on
Patna High Court Cr.Misc. No.10045 of 2016 (2) dt.03-03-2016 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Muzaffarpur Town P.S. Case no. 885/2015. shahid (Hemant Kumar Srivastava,J) U T
