The present petition has been filed with a prayer to restore MJC No.2202 of 2010 which stood dismissed on 21.10.2014 due to non -prosecution.

In this case the petitioner has also filed a supplementary affidavit and ground for non- appearance has been indicated in paragraph no. 2 of the supplementary affidavit. Besides hearing the parties, I have also perused other materials. The grounds set forth in the supplementary affidavit is sufficient to persuade the court for passing positive order. Accordingly, in view of the facts and circumstances, the petition stands allowed.

Patna High Court MJC No.4451 of 2014 (4) dt.22-04-2015 2/2 Let MJC No. 2202 of 2010 be restored to its original file.
