JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-11-2015 Heard learned counsels for the petitioner, informant and the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under sections 366A, 372, 120B of the Indian Penal Code.

The prosecution case is of abducting the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim has got her age recorded as 20 years when the court has assessed as such, though as per the medical report she was found between 17-19 years. In 164 Cr.P.C. statement the victim has stated that she of her own went in the company of the petitioner and has performed marriage with him

Patna High Court Cr.Misc. No.45325 of 2015 (2) dt.05-11-2015 2/2 and wants to leave with the petitioner.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bagaha, West Champaran in connection with Semara P.S. Case No.27 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
