Petitioners apprehend arrest in connection with Durgawati P.S. Case No. 214/15 for offences alleged under Sections 341, 323, 324, 307, 379, 427, 504/34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that the petitioners have committed theft of paddy crop standing in the field of the informant and on objection petitioners also assaulted him.
It has been submitted by the learned counsel for
Patna High Court Cr.Misc. No.9903 of 2016 (2) dt.13-04-2016 2/2 the petitioners that they are innocent having no criminal antecedent and are residents of another village. It has further been submitted that the matter has since been compromised between the parties, injuries are found to be simple in nature and the matter arises out of civil dispute.
However, learned APP for the State submits that the petitioners are named in the First Information Report and opposes the prayer for bail.
Be that as it may, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Durgawati P.S. Case No. 214/15, subject to the conditions as laid down under Section 438(2) Cr.P.C.
