The petitioner seeks bail in connection with Lakhisarai P.S. Case No. 288 of 2017 dated 19.07.2017 though initially instituted for the offence under Section 365 of the Indian Penal Code but later Sections 302, 201 of the Indian Penal Code were also added.

The brother of the informant went missing.

Later, his dead body was recovered. One Sushant Kumar is said to have been arrested during the course of investigation who has disclosed the name of the petitioner in his confessional statement. The petitioner is in custody since 03.08.2017 and does not bear any criminal antecedent.

Regard being had to the fact that name of the

Patna High Court Cr.Misc. No.56552 of 2017 (3) dt.21-12-2017 2/2 petitioner transpired only in the confession of the co-accused and he is not an accused in any other case, this Court is inclined to grant bail to him.

The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 288 of 2017.
