====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 02-09-2019 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 307, 504, 506/34, 302 of the Indian Penal Code and Section 27 of the Arms Act. The FIR would reveal that allegation of firing and commission of firearm injury is against Sheo Kumar, the son of this petitioner. However, the petitioner was also there at the time of occurrence. Petitioner is in custody since 16.03.2019. Investigation of the case is already complete against the petitioner.
Considering the nature of allegation and completion of investigation against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.54494 of 2019(2) dt.02-09-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with S.C. No. 338 of 2019 arising out of Khodawandpur Police Station Case No. 51 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
