In this case, the petitioner is seeking anticipatory bail in connection with Biharshrif P.S. Case No.151 of 2015, registered for the offence punishable under 354A, 504 and 323/34 of the Indian Penal Code and under Section 4/6 of the Protection of Children from Sexual Offices Act, 2012.
Allegation has been made that when the victim was outside the house, the petitioner came and started speaking vulgarly and then the victim started weeping, the petitioner threatened her not to disclose the fact to her parents. On the next day, the parents of the victim came to the house of the petitioner to resolve the
Patna High Court Cr.Misc. No.10107 of 2016 (2) dt.10-03-2016 2/2 dispute, whereupon all the accused persons started assaulting them.
Learned counsel for the petitioner submits that the police station in which the case has been lodged by the victim, was 40 km. away from the village, whereas the petitioner has also lodged a case on 10.11.2015, where it shows that the police station is hardly 13 km. from the village, there allegation has been made that the petitioner was assaulted by the present informant of this case. Looking to the nature of allegation and the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let the petitioner-Deepak Ram @ Deepak Kumar, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Nalanda, in connection with Biharshrif P.S. Case No.151 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U
