ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 13.05.2019 in connection with Shashtri Nagar P.S. Case No. 161/2017 registered for the offence punishable under Sections 302/324/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that he is not named in the FIR and his name has surfaced on the basis of the confessional statement made before the police by coaccused persons which has no evidentiary value. He further submits that other co-accused persons, namely, Manoranjan Giri and Rakesh Kumar Jha have since been extended the privilege of anticipatory bail in connection with the present case vide orders dated 02.02.2018 passed in Cr. Misc. No. 39222 of 2017

Patna High Court CR. MISC. No.54569 of 2019(2) dt.04-09-2019 2/2 and 09.11.2017 passed in Cr. Misc. No. 48028 of 2017 respectively.

Considering the aforementioned facts and circumstances and that the petitioner's name has surfaced on the basis of the confessional statement made before the police, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Patna, in connection with Shashtri Nagar P.S. Case No. 161/2017.
