The petitioner is in custody in connection with Kochadhaman P.S.Case No.106 of 2017 registered for an offence under Section 394 of the IPC.

It has been submitted that the petitioner has clean antecedent and merely on the basis of confessional statement, he has been implicated in this case. The recovered money Rs.3000/- was the personal money of this petitioner. There is no other recovery. The petitioner is in custody since 08.07.2017 and till the date he has not been put on test identification parade. He further submits that similarly situated co-accused Md. Matin @ Matin has been granted bail by a coordinate Bench of this Court in Cr.Misc.No.57728 of 2017.

Patna High Court Cr.Misc. No.63068 of 2017 (2) dt.11-01-2018 2/2 Learned APP opposed the submissions.

Considering the case of this petitioner on similar footing, facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-I, Kishanganj in connection with Kochadhaman P.S.Case No.106 of 2017.
