JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with complaint case no. 438C2 of 2017 instituted for the offences punishable under Section 30(a) of the Bihar Excise and Prohibition Act, 2016.

The allegation is regarding recovery of 14.04 ltrs. of illicit liquor from the orchard which does not belong to the petitioner herein, however since the petitioner had gone to his relative where raid was conducted, the petitioner was also apprehended.

The learned counsel for the petitioner submits that the petitioner has got no role in the alleged incident and he had

No.63512 of 2017 (2) dt.17-01-2018 2/2 merely gone to meet one person namely Ram Balak Singh where the raid was conducted and on account of recovery of illicit liquor, the petitioner was falsely implicated in the present case. It is further submitted that the petitioner has a clean antecedent and he is in custody since 22.11.2017.

Considering the nature of accusation, clean antecedent of the petitioner and the period of custody undergone, I deem it fit and appropriate to enlarge the petitioner on regular bail. Accordingly, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of ADJ-VII-cum-Special Judge, Excise, Begusarai in connection with complaint case no. 438C2 of 2017.
