JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2016 Petitioners being parents of the husband of the complainant are apprehending their arrest in a complaint case filed with accusation under Sections 323, 504, 498A of the Indian Penal Code, wherein processes were directed to be issued after cognizance being taken.
The basic accusation is of torture and making an attempt to kill the complainant.
It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the entire in-laws family including the petitioners. The thrust of accusation is against the husband of the complainant. The petitioners are old persons and claim to be separate from the husband of the complainant.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or
Patna High Court Cr.Misc. No.10894 of 2016 (2) dt.04-03-2016 2/2 surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada in connection with Complaint Case No. 120 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
