JUSTICE JYOTI SARAN ORAL ORDER 14-12-2017 Heard Mr. Kaushal Kishor, learned counsel for the petitioner, learned counsel for the State and Mr. S.S.Sundaram, learned counsel appearing for the Staff Selection Commission. The writ petition was filed by the petitioner feeling aggrieved by his name not appearing in the list of qualified candidates in a selection process that had followed pursuant to advertisement No. 07010115 for the post of Senior Scientific Assistant, Forensic Science Laboratory, Bihar, Patna. A counter affidavit is filed and while at paragraph 4 it is stated that the earlier result published under the advertisement was cancelled and a fresh scrutiny of the applications is taking place, it is further stated at paragraph 7 that in fresh exercise of selection

Patna High Court CWJC No.6828 of 2016 (4) dt.14-12-2017 process the case of the petitioner would also be considered in accordance with law.

In view of the statement made in paragraphs 4 and 7 of the counter affidavit filed on behalf of the Commission that the earlier selection process has been cancelled and scrutiny is underway of the application(s) filed, that the petitioner had participated in the earlier selection process and had also qualified for interview, there cannot be any doubt on her candidature for participation in the fresh selection process. With the observation aforementioned, the writ petition is disposed of.
