The petitioners are apprehending their arrest in connection with Bhabua P.S. Case No. 54 of 2016 for the offences instituted under Sections 147, 149, 353, 427, 435, 323, 504 and 295 of the IPC.
The prosecution story, in brief, is that one person in the village was killed by another co-villager of another community police reached there to control law and order and found 500-700 persons led by the FIR named accused persons, they made an attempt to kill the other inmates of the house of the accused, set fire in the hay stalk and not allowing the police to extinguish fire,
Patna High Court Cr.Misc. No.11160 of 2016 (2) dt.25-04-2016 2/2 any how the police save the life of the family members of the accused of the murder of Satwant Patel.
It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. FIR has been instituted against 15 named persons alongwith 700 unknown persons. No specific allegation has been made against the petitioners. General and omnibus allegation has been made against the petitioners.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Bhabua P.S. Case No. 54/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
