JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-11-2015 Heard learned counsel for the petitioners. Despite repeated calls, none appears on behalf of the State. The petitioners seek pre-arrest bail in connection with Mansahi P.S.Case No.62 of 2015 registered under Sections 341, 323 and 328/34 of the Indian Penal Code.

It is contended that the petitioners have been falsely implicated in the present case. The alleged occurrence is said to have taken place on 2.8.2015, but the FIR was registered on 10.8.2015 and there is no reasonable explanation for the delay caused in lodging the first information report. Regard being had to the facts and circumstances of the

No.49374 of 2015 (2) dt.04-11-2015 2/2 case, in the event of arrest or surrender in the court below within four weeks from today, the above named petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri B.B.Roy, Judicial Magistrate, 1st Class, Katihar in connection with Mansahi P.S. Case No.62 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
