2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 191(2), 115(2), 316(5), 318(4), 132, 308(3), 352, 351(2)/3(5) of the BNS..
3. It is alleged that petitioner no.1, who was the Chairman of the Managing Committee of Prince Mohan Bikram Shah College, Ramnagar, in connivance with other co-accused illegally withdrawn Rs.35 Lakhs. It is further alleged that on 21.08.2024, all the accused persons, including the petitioners,
Patna High Court CR. MISC. No.60776 of 2025(2) dt.24-09-2025 2/3 came in the college premises, abused and assaulted informant and others and also forcefully opened Almirah and took away all the relevant documents.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioner no.1 is the Donor/Adhyaksh, petitioner no.2 is the son of petitioner no.1 and petitioner no.3 is the Principal-cum-Secretary of the Administrative body/Managing Committe, Prince Mohan Bikram Shah College, Ramnagar and are simply victims of false implication in retaliation to a case bearing Ramnagar P.S. Case No.551/2024 dated 29.11.2024 filed by the petitioner no.1 against the informant and others. Petitioners have been made accused without any specific allegation due to a dispute regarding management which was going on in between the informant on the one hand the Administrative/Managing Committee on the other. Learned counsel further submits that on 05.08.
2017, members of College Managing Committee empowered the Chairman of the Committee to operate the College account and not only this, they, vide letter dated 16.08.2024, authorized the petitioner no.1 to hold enquiry into the misappropriation of fund amounting to Rs.
Patna High Court CR. MISC. No.60776 of 2025(2) dt.24-09-2025 3/3 which, ultimately, he had to lodge the case. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case, rival submissions, general and omnibus nature of accusation, clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran, in connection with Ramnagar P.S. Case No.580 of 2024, subject to condition as laid down under Section 482(2) of the B.N.S.S.. (Prabhat Kumar Singh, J) pallavi/- U T
